The mentioned International Health Regulations and the WHO Charter clearly describe the powers and procedures for the actions of WHO officials. They do not state any right to declare a pandemic. There are hundreds of such messages on the website of the Government of the Russian Federation. And the same are also found on the websites of all state authorities that are directly or indirectly subordinated to the Government of the Russian Federation, that is, there are probably tens of thousands of them.

In fact, the Government of Russia allowed and became an accomplice on the territory of our state in the active spread of panic disinformation and the position of an international organization which was voiced by its leader in violation of the international legal norms, that is, in fact, was illegal and had a subversive nature for the economy, life and health almost all residents of Russia.

Moreover, this position was taken up by the Government of Russia without assessing the threat adequacy, turned into maximum pressure in mass media, where tens of thousands of publications about it appeared.

This position is supported even in the decisions of higher courts, for example, in the Resolution of the Constitutional Court of the Russian Federation № 49-POn the case of checking the constitutionality of subparagraph 3 of paragraph 5 of the resolution of the Governor of the Moscow Region “On the introduction in the Moscow Region of a high alert regime for the authorities and forces of the Moscow Regional system for the prevention and liquidation of emergency situations and some measures to prevent the spread of a new coronavirus infection (COVID-2019) on the territory of the Moscow Region "in connection with the request of the Protvinsky City Court of the Moscow Region", - there is a reference to the constitutional norms about the epidemic, but without verification of the fact of the presence of an epidemic itself, and a pandemic is taken for granted based only on the statement of the Director-General of WHO at the briefing.

The Decree does not evaluate the applicability in this case of the Federal Law “On the Protection of the Population and Territories from Natural and Technogenic Emergencies”, while the rights of citizens during epidemics are regulated by a completely different, special law – “On the Sanitary and Epidemiological Welfare of the Population”, and are contained in the law.

Such work of the courts itself causes moral harm by the low quality justice activity, the unfair and biased decision of the highest Russian court in favor of the state against citizens.

In their desire to intimidate the population, Russian government officials equated COVID-19 with the plague and the Spanish flu - the worst diseases of the past.

So, in case № AKPI21-77 considered by another highest court of Russia - the Supreme Court of the Russian Federation[7]in favor of the Government of the Russian Federation, in Appendix № 3 to the Amended objections, paragraph 3, the representatives of the defendant - the Government of the Russian Federation - wrote: “By the number of deaths, as of April 2021, COVID-19 is already more than twice the size of the Spanish flu pandemic: 2.7 million versus 1.2 million

However, according to Rospotrebnadzor[8] and the WHO, 50 to 100 million people died from the Spanish flu. Thus, this is a direct lie of official representatives of the Government of the Russian Federation exactly in the Supreme Court of the Russian Federation generated in order to intimidate the population and the court.

Public (in the press) equation of pathogenicity of COVID-19 to plague by Vice Prime Minister of the Government of the Russian Federation Golikova T.A. is deliberately false, since plague belongs to the first group of pathogenicity[9], and covid - to the second one (and this, not taking into account the disputes about the feasibility of introduction COVID-19 to the second group)[10]. The mass media, as we see, spread this lie in all the blackest versions and details, without criticism and the opinion of opponents.

The illegal use of terms “pandemic” and “epidemic” in relation to COVID-19 has consequences for the entire country and, in particular, for us.

· With the repeated, massive, aggressive use in the press and on the websites of the authorities, fear, depression and panic were created throughout society;

· Medical organizations appeared to be filled with non-profile patients and were re-profiled because the decisions made by the authorities frightened people and even obligated citizens to be hospitalized if they suspected ARVI;

· Using these concepts, restrictions were introduced on the basic constitutional rights of citizens - to freedom of movement, including leaving their own homes, to work, to entrepreneurship, to education;

· Distance forms of learning introduced under the “pandemic” has harmed the mental and physical health of children and adults;

· Under fear of the pandemic, untested “vaccines” and drugs were widely used; in less than two years, the Russian Ministry of Health has adopted 14 recommendations for the prevention and treatment of COVID-19 which is hard to imagine for achieving a safe effect. Physicians did not have time to learn how to apply these methods;

· In accordance with the regulatory legal acts of Rospotrebnadzor, citizens are required to wear two masks - medical and hygienic, although the safety of none of them for consumers has been proven, and wearing a mask itself has constantly created conflicts between people, up to attacks, not to mention millions of fines for the right to breathe freely;

· Cultural life of the country was paralyzed - concerts, museums, exhibitions for the most part did not work or were not available without additional conditions.

 

In 2020, with the appearance of COVID-19, the WHO has created a new term - “infodemic”, which surprisingly accurately reflects the negative information campaign that the WHO itself supports with the support of the governments of many countries, including the Government of the Russian Federation. On its website, WHO issued a warning about the threat of an infodemic - an excess of information that can be misleading or even harmful. It says that huge amounts of information can be hazardous to human health for the following reasons:

There is no doubt that the WHO and the Government of the Russian Federation have been doing just that for the past 2 years, creating a panicking environment based on misinformation about the pandemic and the epidemic. We are talking about millions of publications in all media and on the websites of government bodies.

We present another document that describes the consequences of such a lie very well, which makes it possible not even to prove its consequences, but simply to refer to them as facts confirming the existence of moral harm and demand compensation for it.

The document is presented as a Joint Statement by the WHO, UN, UNICEF, UNDP, UNESCO, UNAIDS, ITU, UN Global Pulse and IFRC. It is titled “Managing the COVID-19 Infodemic: Promoting healthy behaviours and mitigating the harm from misinformation and disinformation” [11] .
